Japan Permanent Residence Guideline Revision (Feb 2026): 5-Year Period Now Required

The Immigration Services Agency of Japan revised the “Guidelines for Permission of Permanent Residence” on February 24, 2026. The revision includes several important changes to the screening criteria for permanent residence applications. Basic Requirements (Unchanged)

Three fundamental requirements must be met to obtain permanent residence permission. These have not changed:

  • Good Conduct: Complying with laws and living a life that is not socially condemned as a resident
  • Financial Independence: Able to support oneself or be supported through assets and skills (not receiving public assistance)
  • Conformity with the National Interest: The person’s permanent residence is recognized as being in Japan’s national interest (generally requires at least 10 consecutive years of stay in Japan, including at least 5 years under a work or residential status)

Key Changes in the February 2026 Revision

① Stricter Residence Period Requirement: “5 Years” Now Required

Previously, having a residence period of “3 or 5 years” was considered sufficient. After the revision, having a residence period of “5 years” is now required in principle.

However, a transitional measure has been established: for applications filed by March 31, 2027, a 3-year residence period will be treated as equivalent to 5 years. This transitional measure applies only once.

If you currently hold a 3-year residence period, filing your application by March 31, 2027 may allow you to benefit from this transitional measure. After this deadline, you will need to obtain a 5-year residence period before applying.

② Stricter Deadlines for Public Obligations

Regarding public obligations such as taxes, pension, and health insurance, timely payment by the original due date is now more explicitly required.

Even if you have paid everything in full by the time of application, late payments made after the original due dates will generally result in a negative assessment. Always pay your pension, national health insurance, resident tax, and income tax by the due dates.

③ New Requirement: Continued Compliance with Landing Permission Standards

Continued compliance with the landing permission standards for your current residence status has been added as a component of the national interest requirement.

For example, if you hold “Engineer/Specialist in Humanities/International Services” status, you must still meet the standards for that status (matching education and job duties) at the time of your permanent residence application.

④ Terminology Update: “Imprisonment” → “Confinement Sentence”

Following the 2022 revision of the Penal Code, which merged “imprisonment with labor” into a unified “confinement sentence,” the terminology in the guidelines has been updated accordingly. There is no substantive change to the screening criteria.

Points to Note When Applying

  • Check your residence period: Verify whether your residence card shows “5 years.” If you have “3 years,” plan your application ahead of the March 31, 2027 transitional measure deadline.
  • Review your payment history: Check your pension, health insurance, and tax payment records for the past 5 years. If there were any late payments, consult a specialist.
  • Compliance with residence status standards: Ensure your current work activities comply with the standards for your residence status, especially if you have changed jobs or job categories.
  • Document preparation: Application documents are extensive. Missing or incomplete documents can cause significant delays.
